Terms of Service
Effective: 27 April 2026 · Jurisdiction: Zimbabwe & South Africa
These Terms of Service ("Terms") govern your access to and use of the Ziviro agricultural intelligence platform ("Ziviro", "the Service"). By sending a message to Ziviro or registering for early access, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Ziviro is an AI-powered agricultural intelligence platform delivered through WhatsApp. The Service provides:
- Daily farm intelligence briefings including weather, commodity market prices, crop health alerts, and livestock disease calendar updates
- Conversational AI advisory responding to farming questions in English, Shona, and Zulu
- Satellite-based NDVI crop health monitoring linked to your farm location
- AI-powered analysis of farm images and voice notes you submit
- Livestock disease symptom triage and veterinary guidance suggestions
- Commodity market price tracking using data from SAFEX, JFPM, and farmer-reported prices
- Farm worker task delegation and check-in management
2. Agricultural Advice Disclaimer
IMPORTANT: Information, analysis, and guidance provided by Ziviro does NOT constitute professional agricultural, agronomic, veterinary, or financial advice. The platform uses AI models, satellite imagery, and historical datasets that are subject to variability and error. You must consult a qualified agronomist, veterinarian, or financial advisor before making significant decisions about your crops, livestock, or finances based on Ziviro's output. Ziviro accepts no liability for losses arising from reliance on its guidance.
Specifically:
- Disease diagnosis responses are indicative only — a qualified veterinarian must examine sick animals
- Market price data is for reference and may not reflect current local depot prices
- NDVI crop health alerts are based on satellite data which may be affected by cloud cover, calibration errors, or seasonal variation
- AI responses are generated probabilistically and may contain errors or outdated information
3. WhatsApp Channel & Meta's Terms
Ziviro is delivered exclusively through WhatsApp. By using Ziviro, you acknowledge that:
- Your use of WhatsApp is governed by Meta's own Terms of Service and Privacy Policy
- Ziviro is not responsible for message delivery failures, delays, or service interruptions caused by the WhatsApp platform or your mobile carrier
- In the event of WhatsApp unavailability, Ziviro may deliver critical alerts via SMS through Africa's Talking — standard carrier rates may apply
4. User Commands & Responsibilities
You can control your Ziviro experience using the following WhatsApp commands:
- STOP — deactivates your account and stops all messages
- MY PROFILE — view your registered farm details
- MY FARM — view your current farm configuration
- UPDATE — update your farm profile information
- HELP — display available commands
By using Ziviro you agree to:
- Provide accurate information about your farm, location, and livestock during onboarding and updates
- Use the Service only for lawful agricultural purposes within Zimbabwe and South Africa
- Not attempt to reverse-engineer, scrape, or circumvent the platform's systems
- Not send spam, abusive, offensive, or misleading content through the Service
- Not use Ziviro to facilitate illegal activity or cause harm to others
5. Farm Worker Management
If you register farm workers under your account to use the task delegation and check-in features, you are responsible for:
- Obtaining the consent of each farm worker before registering their phone number with Ziviro
- Ensuring farm workers understand that their activity (task completions, check-ins, messages) will be visible to you as the account holder
- Complying with applicable labour law and privacy obligations when managing farm worker data
6. Market Price Information
Commodity prices shared by Ziviro are sourced from SAFEX, JFPM, and crowdsourced farmer reports. This data is provided for general awareness only and does not constitute financial or trading advice. Prices may vary significantly between depots, regions, and dates. Always verify prices directly with buyers or markets before making selling decisions.
7. Intellectual Property
All content, AI models, software, and technology underlying the Ziviro platform are the intellectual property of Ziviro. You may not reproduce, redistribute, reverse-engineer, or create derivative works from the Service without our prior written permission. Farmer-reported data (e.g. prices you submit) remains yours — we use it only to improve the collective market intelligence available to all users.
8. Service Availability
We aim to provide continuous, reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any feature with reasonable notice. We will not be liable for temporary service interruptions caused by maintenance, third-party outages, or events beyond our control.
9. Limitation of Liability
To the maximum extent permitted by applicable law in Zimbabwe and South Africa, Ziviro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Crop yield losses or livestock deaths arising from reliance on AI-generated guidance
- Financial losses arising from market price information
- Inaccuracies in satellite data, soil analysis, or weather forecasts
- Loss of data due to WhatsApp or third-party service interruptions
Our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or ZWL 500 / ZAR 200 if no payment has been made.
10. Governing Law
These Terms are governed by the laws of the Republic of Zimbabwe and the Republic of South Africa, as applicable based on your registered country. Disputes shall be resolved in the courts of your registered jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via WhatsApp before they take effect. Continued use of the Service after changes constitute your acceptance of the updated Terms. Current Terms are always available at ziviro.app/terms.
